The Family Court of Australia’s View on Child Abuse
The Family Court of Australia’s paramount objective is to consider ALL circumstances involved to decide what is in the best interests of the children.
A recent decision in the Court of Appeal overturned a decision for the father to spend an indefinite amount of supervised time with the children.
The Court stated that all evidence must be heard to determine risk of child abuse occurring if custody or access is to be granted and it is the Court’s duty to assess the magnitude of that risk. The Court of Appeal found that the risk of abuse to the children were not substantial to warrant an indeterminate period of supervised time, taking into consideration all evidence provided, particularly expert evidence reports.
