Are you looking for a dynamic Brisbane law firm to prepare your Will, Estate and Power of Attorney?

Making a Will and its benefits:

Dying is a fact of life. What do you do when someone you love dies, and that person has not taken care of his/her estate by making a Will?

If you do not have a Will prepared ready for when you die, your assets could be distributed so that the people you love are forgotten in the mess that ensues - do you want that to happen?

If you have minor children and you die without a will, someone else decides who becomes the guardian of your children.

Your Will is a complex legal document which states how you want your estate to be divided after your death.

Your Will also nominates the person (Executor)to oversee the distribution of your estate and the beneficiary is entitled to receive any part of your estate or assets.

Any person over the age of 18 years and of sound mental capacity can make their Will.

You need to consider a few issues before making your Will, including the following:

Have you left it too late to prepare your first will?

Our Will drafting service is our traditional service where we draw your Will as per your instructions and requirements without any formal analysis of your financial position

Your Will may be revoked or not valid upon the following events:

Please contact our office on 3345 4388 to receive a free Will Instruction Kit, which we ask you to complete prior to visiting our office for a consultation.

If you are unsure of circumstances that affect you, please do not hesitate to raise any questions with us at our office.

If you give us the privilege of preparing your will, you can avail of the following benefits our experienced team of Brisbane lawyers offer:

As we initially prepare your Will, we make sure that your Will accurately reflects your circumstances.

If there has been family, personal or financial changes in your life, you should call us to review your Will to ensure it remains both accurate and appropriate.

All you need to do is to Email us through this web site to take advantage of our discount of 5% to prepare your Will.

Please discuss any changes in your circumstances and how you wish them to be reflected in your Will, and we make sure the document is changed. If the changes are simple - like a change of address, or a name change, you incur no fee.

If you require other than "simple changes" to your Will - such as the removal, addition or alteration of a clause, then our fees start from $50.00.

This alteration service is a whole lot less than a new Will which starts at $195.00 plus GST.

If your circumstances have changed to a point that your Will requires a complete redraw, further fees will be discussed at the time

If you are our client, we also offer a free Annual Will Review Service.

Please consider your loved ones and book now to ensure your and their future by either calling us on (07)3345 4388 or Mail us.

WHEN AND WHY DO I NEED A POWER OF ATTORNEY?

When you find it difficult to deal with your own affairs, it is time you considered the appointment of a person to handle those affairs.

A Power of Attorney is a legal document by which you can authorise another person, or a number of people together, to act on your behalf.

The circumstances under which giving a Power of Attorney is advisable is when:

  • You are, say Brisbane based, and you are travelling overseas
  • You are admitted into a hospital or nursing home
  • Your physical movements are limited
  • You are deteriorating mentally through illness or age.

When you are away or take ill, having an Attorney who can deal with your affairs efficiently, will give you peace of mind.

The Power of Attorney must be in writing and in the approved format, and, if it is to be used for property transactions, it must be registered with the Department of Natural Resources.

When granting a Power of Attorney, you must also have the capacity to do so. If there are any doubts as to your capacity to grant the Power of Attorney, evidence will be required from your Doctor prior to your signing any document

Assuming you are granted Power of Attorney, you can continue to deal with your personal affairs at the same time as you discharge the other person's responsibilities that you have assumed by taking on the Power of Attorney.

An Advance Health Directive is a separate document setting out in detail your express directions regarding your future health care which operates when you lose your capacity to make those directions yourself.

Please Email us through this web site to avail of our discount of 5% on our Power of Attorney Service.
