In late 2004, Hatzis Lawyers actively assisted clients in company and partnership disputes.

In 90% of these cases,

  1. one of the parties had made a unilateral decision to either terminate the partnership or
  2. sell their share in the company, prior to negotiating their respective rights upon leaving.

When the other party failed to comply with the proposed settlement terms, our clients were left in a perilous position and were in the unfortunate circumstance of not having the funds required to litigate the dispute (take it to Court).

Had they not quit the partnership or sold their company share, they would have had equal rights as the other party and had access to the books of the particular organization, so that proper advice could have been given.

We have successfully terminated franchise agreements on behalf of franchisees who have purchased businesses for a large sum of money upon which they had to do all the work and for which the franchisor gave very little assistance.

We have acted for purchasers of businesses who have been supplied with fudged figures and successfully sued the seller to recover the funds paid for that business.

A litigation solicitor will be in a good position to review any documentation you have signed and to take the initial step that is required under that agreement so that any rights are not lost.

For instance, certain agreements state that if there is default then the seller or supplier has to be notified within fourteen days of delivery, and if not then the goods are deemed to be accepted.
