A SOLICITOR’S WILL vs A WILL PACK
The following are some of the advantages to your solicitor drafting your Will as opposed to you completing a do-it-yourself Will pack:
- You have a face-to-face consultation with a solicitor and can discuss your intentions and how these are best reflected in your Will.
- Your solicitor can guide you and alert you to pitfalls as a result of intentions that have not been thought out properly.
- Your solicitor can alert you to any issues in relation to your superannuation, your company constitution and your trust deed (if applicable).
- Your solicitor can act as your Executor/Trustee if you wish.
- Your solicitor will ensure that your Will is completed and executed properly and in accordance with the Succession Act, therefore limiting the risk of non-compliance which can declare your will null and void.
- Your solicitor can also provide you with an estate planning consultation, especially if your matters are complicated by way of a company or a trust to enable you to make informed decisions in relation to your estate.
- Your solicitor may keep your original Will in their securities for safe keeping at no charge.
- Your solicitor can remind you to review your Will on a yearly basis to ensure that your Will is always up to date.
You may see a Do it Yourself Will pack as cheaper, quicker and more convenient but is it hole proof?
You spend your entire life building up your Estate, so it is imperative that at the end of the day your Estate is distributed in accordance with the clear intentions in your Will with no possibility of complications, contingencies and disputes.
